WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INFORMED CONSENT

This is an important legal document. It explains the risks associated with participation in exercise, fitness, and wellness activities provided by Brunner Sports Development & Fitness, LLC (“Company”). Please read this document carefully and completely before signing.

By signing this document, you acknowledge that you understand and voluntarily accept the risks associated with participation in physical activity, exercise training, fitness instruction, wellness coaching, online coaching, and related services.

1. Voluntary Participation

I, the undersigned Client, voluntarily choose to participate in fitness training, exercise programming, coaching, wellness consultation, nutrition guidance, online services, and/or related activities provided by Brunner Sports Development & Fitness, LLC and/or its owner, employees, contractors, coaches, representatives, or agents, including but not limited to Dusten Brunner.

These activities may include, but are not limited to:

  • Strength and resistance training

  • Cardiovascular exercise

  • Mobility and flexibility training

  • Corrective exercise

  • Sports performance training

  • Functional movement training

  • Online fitness programming

  • Virtual coaching sessions

  • Exercise demonstrations

  • Nutritional and lifestyle guidance

2. Assumption of Risk

I understand that participation in exercise, physical activity, and training programs involves inherent risks, including but not limited to:

  • Muscle strains or tears

  • Sprains

  • Falls

  • Equipment malfunction

  • Dizziness or fainting

  • Elevated heart rate or blood pressure

  • Heart attack

  • Stroke

  • Serious injury

  • Permanent disability

  • Death

I acknowledge that these risks may result from my own actions, the actions of others, the condition of equipment or facilities, or the negligence of Brunner Sports Development & Fitness, LLC.

I knowingly and voluntarily assume full responsibility for all risks associated with participation in any activity or service provided by the Company.

3. Medical Acknowledgment

I acknowledge that I am responsible for consulting with my physician prior to participating in any exercise or fitness program.

I affirm that:

  • I am physically capable of participating in exercise activities, OR

  • I have obtained appropriate medical clearance from my physician.

I understand that Brunner Sports Development & Fitness, LLC does not provide medical diagnosis, treatment, or rehabilitation services.

I agree to immediately inform the Company of any pain, discomfort, injury, dizziness, illness, or medical concern experienced before, during, or after participation.

4. Release and Waiver of Liability

In consideration for being allowed to participate in services provided by Brunner Sports Development & Fitness, LLC, I hereby voluntarily release, waive, discharge, and hold harmless:

  • Brunner Sports Development & Fitness, LLC

  • Dusten Brunner

  • Any employees, contractors, coaches, trainers, representatives, agents, successors, or assigns

from any and all claims, liabilities, demands, damages, causes of action, costs, or expenses arising out of or related to any injury, illness, loss, or damage that may occur as a result of participation in any Company service or activity.

This release includes claims arising from:

  • Negligence

  • Equipment malfunction

  • Improper instruction

  • Improper supervision

  • Facility conditions

  • Online or virtual coaching participation

  • Home exercise participation

  • Travel to or from training locations

5. Home, Remote, and Online Training

If I participate in workouts, coaching, or exercise sessions at home, outdoors, virtually, or at a location not owned or controlled by Brunner Sports Development & Fitness, LLC, I acknowledge and agree that:

  • I am solely responsible for the condition and safety of my workout environment.

  • I am solely responsible for any equipment used during workouts.

  • The Company has not inspected my home, facility, equipment, or training area.

  • I assume all risks related to the location, environment, surfaces, weather conditions, and equipment utilized.

I further agree to hold harmless Brunner Sports Development & Fitness, LLC and Dusten Brunner from any claims arising from unsafe conditions, equipment failure, property hazards, or injuries occurring during remote or online participation.

6. Equipment Acknowledgment

I understand that exercise equipment may malfunction, break, move unexpectedly, or cause injury.

I voluntarily assume all risks associated with:

  • Free weights

  • Resistance bands

  • Cardio equipment

  • Suspension systems

  • Athletic equipment

  • Home gym equipment

  • Any other exercise-related tools or devices

7. No Guarantee of Results

I understand and acknowledge that:

  • Results vary between individuals.

  • No specific fitness, health, performance, or weight-loss outcomes are guaranteed.

  • My results depend on factors including consistency, effort, nutrition, recovery, sleep, stress management, and lifestyle behaviors.

8. Photography, Video, and Media Release

I grant permission to Brunner Sports Development & Fitness, LLC to photograph, record, or videotape my participation, image, voice, likeness, or performance for educational, promotional, social media, website, or marketing purposes.

I understand:

  • Such media may be used without compensation.

  • I may revoke media permission in writing at any time for future use.

  • Participation in media is voluntary and is not an endorsement of any product or service.

9. Client Rights

I understand that:

  • I may stop any exercise or activity at any time.

  • I may refuse any recommended exercise.

  • I should immediately communicate any pain, discomfort, dizziness, or medical concern.

10. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Florida.

If any portion of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. Acknowledgment and Signature

I acknowledge that:

  • I have carefully read and fully understand this Waiver, Release of Liability, Assumption of Risk, and Informed Consent Agreement.

  • I understand that by signing this document I am giving up substantial legal rights.

  • I sign this agreement voluntarily and without coercion.
